He can, but keep in mind that the curse is designed for Regina's rule to be essentially unquestioned and absolute; as such it is very likely that Lucifer's Storybrooke persona has either run against her several times before and so far always lost by a mile, or that it never even occurred to him to run against the current mayor until the second day of the event, when people's lives start to change.
